GENERAL CONDITIONS OF SALE 

These general conditions of sale (hereinafter the "General Conditions") govern the terms and conditions of sale of products (hereinafter "Products") sold by Paradise Inflatable Srl with registered office in Milan at Piazza Borromeo n. 14, registered at the Chamber of Commerce of Milan n. Rea 1885247, VAT 06324990966 (hereinafter "Paradise Inflatable").
All contracts for the sale of Products by Paradise Inflatable to third parties, whether they are natural persons acting for purposes unrelated to the business (hereinafter, the "Consumer"), or natural or legal persons acting in the exercise of its activity (hereinafter the "Professional" and, together with the consumer, the "Customer") are governed by these Terms and Conditions, which form an integral and essential part of any proposal, order and order confirmation of purchase of the Products. The conditions of sale apply to each order for each customer are those in force on the date of the order.

 

ART. 1 PRICES
All prices for Products are exclusive of VAT and carriage. The rates will be applied in accordance with the provision in force at the time of payment. In the case of delivery abroad will be charged to the customer any additional costs due to taxes or duties imposed by law in the State of destination.
The costs of delivery of the product covered by the order are quantified and communicated at a later time, however, before the completion of the sale, because the courier chosen, the place of execution of delivery, the type and quantity of the product covered by the order .
Paradise Inflatable reserves the right to confirm or modify at any time the prices of products posted on its website or in brochures and advertising material. If these changes occur after sending the order by the Customer, Paradise Inflatable communicate the same to the customer and these will have the right to confirm or reject the order as amended.

 

ART. 2 ORDERS
The sale is completed by the sending of the order confirmation to the Customer by the Paradise Inflatable, following the receipt by the Paradise Inflatable order of the Customer. All orders for Products transmitted to Paradise Inflatable should be complete in their entirety and must contain all the elements necessary for the correct identification of products ordered, including:
a) the exact name or business name and full address of the customer;
b) the number of tax code and VAT number of the customer;
c) the exact code for each product required.
Paradise Inflatable reserves the right not to accept orders incomplete and not properly completed.

ART. 3 TRANSPORTATION, DELIVERY AND RESPONSIBILITY
The goods travel at the risk of Paradise Inflatable. The risk, however, is transferred to the customer as early as the time of delivery of the Product to the carrier, unless it has been chosen by the customer and is not offered by Paradise Inflatable.
The estimated delivery time will be mutually agreed by the parties, in each case, and indicated in the relevant order.
Any delay in delivery by Paradise Inflatable less than 30 (thirty) working days from the date agreed upon, shall not entitle the customer to refuse delivery of the Products, or to claim damages or compensation of any kind and to demand the return of the amount already paid as an interim dividend in respect of the Products.
The obligation to deliver is fulfilled by Paradise Inflatable by transfer of liquid material or otherwise control the product to the customer.
Paradise Inflatable assumes no liability for disruptions caused by force majeure of any nature and kind, should not be able to execute the contract on time. Are due to force majeure, for example and without limitation, the provisions of the Public Authority, the strike carriers the Paradise Inflatable uses, and any other circumstance which is beyond the control of the latter.
Paradise Inflatable will not be liable for any damages, losses and costs incurred by the Customer as a result of breach of contract for reasons not attributable to having the customer shall only be entitled to a refund of the price paid and any costs incurred ..
Without prejudice to the case of willful misconduct or gross negligence of Paradise Inflatable, it is now agreed that, if found responsible for Paradise Inflatable in any capacity against the customer - including the case of default, in whole or in part, to obligations assumed by Paradise Inflatable against the Customer as a result of the execution of an order - the responsibility of Paradise Inflatable shall not be higher than the price agreed upon and paid for the products purchased by the customer and for which the dispute arose.
Paradise Inflatable no warranties as to the compatibility of products with other products used by the customer, or give any guarantee regarding the suitability of the products for the specific use intended by the customer does not comply with the intended destination for the Products.

 

ART. 4 COMPLAINTS OF PROFESSIONAL
Paradise Inflatable ensures only the physical integrity of the Products at the time of delivery.
Should be visible defects of the Products to the delivery, the goods will have to be withdrawn "conditional" and with complaint of any anomalies in the bottom of the transport document. It is understood that complaints against defective parts and / or missing parts must in any case be sent to Paradise Inflatable, under penalty of forfeiture, by registered mail no later than five (5) days from receipt of goods. ART. 5 RIGHT OF WITHDRAWAL AND LIMITED WARRANTY FOR THE CONSUMER
In accordance with the provisions of Legislative Decree no. n. 205/2006, as well as update (hereinafter, the "Consumer Code"), the consumer has the right to terminate the contract, without giving any reason, within 14 (fourteen) working days from the day of receipt of the product.
In the event that the consumer elects to exercise the right of withdrawal, you must inform the Paradise Inflatable by an unequivocal statement to be sent, before the expiry of the withdrawal period, or by fax to n. 0883348524, or e-mail address info@pgoplay.com, or by registered / ra Paradise Inflatable, via Ferdinand of Aragon n. 114 / a in Barletta (BT).
The customer may not exercise the right of withdrawal, among others, in the case of goods made to measure or custom.
In case of exercising the right of withdrawal, Paradise Inflatable refund to the consumer any payments received in relation to that product without undue delay and in any event no later than 14 (fourteen) days from the day you had the information of the decision to terminate the contract by the Consumer. Such refunds will be made using the same method of payment used by the consumer for the initial transaction, unless he has expressly agreed otherwise.
The cost of returning the product shall be borne by the consumer and vary depending on the product.
The reimbursement may therefore be suspended until receipt of the Product, or until the system demonstration by the Consumer of having sent back the goods, whichever is earlier.
The returned products must be returned intact, unused and in original packaging. The Consumer shall be liable for any diminished value of the product resulting from the handling of the same other than that necessary to establish the nature, characteristics and functioning of the goods.
Paradise Inflatable also assumes all obligations relating to the legal guarantee for non-conforming products in accordance with Articles 129, 130 and 132 of the Consumer Code. To exercise the right to the legal guarantee in case of non-conforming product, the consumer will have to contact Paradise Inflatable addresses mentioned above.

 

ART. 6 CONTRACT TERMINATION AND TERMINATION CLAUSE
Paradise Inflatable has the right to terminate the contract by giving notice to the customer with adequate and justified reasons; in this case the customer will only be entitled to a refund of any sums already taken and paid.
ART. 7 SPECIFICATIONS
Paradise Inflatable reserves the right to change specifications without prior notice of its production / marketing as a function of the continuous technological developments.

ART. 8 CONFORMITY
Paradise Inflatable declares that all raw materials used are in accordance with the Community provisions EN 71 (Legislative Decree no. N. 313 of 09/27/91, as amended) and is exempt from any liability for the use and installation that is made of Products sold by the Customers.

 

ART. 9 ITEMS SOLD
In the case of out of stock of a particular product ordered, will be held at the Paradise Inflatable simple repayment of any advances received for this product.
ART. 10 DISPUTES
Without prejudice to the provisions of the Consumer Code in relation to the Consumer, any dispute related to these Terms and Conditions, will be under the exclusive jurisdiction of the Court of Trani.

 

ART. 11 PAYMENTS
The payment of the Products must be paid under the conditions of payment accepted by the customer. This payment must be made ​​exclusively by:
Cash on receipt of the goods;
Bank transfer to account no. IBAN IT 03 O 02008 04030 000011146103.

 

ART. 12 PRIVACY
